This notice explains how JMS Publishers and Providers Limited ("we", "us"), trading as Pass 11 Plus Grammar and PASS my GCSEs, uses personal information about parents, carers, pupils and website visitors. We are the data controller.

What this notice covers
Personal information is information about a living person who can be identified from it, on its own or together with other information we hold. Special category information is more sensitive. For us, that is mainly health information and information about special educational needs, which we use only to teach and care for a child safely.
Why we use personal information
We use pupil information to teach, to monitor and report on progress, to provide pastoral care and learning support, to keep children safe, and to run mock exams and classes. We use parent and carer information to contact you, to report on your child's progress, and to take payment of fees.
The information we hold can include names, addresses, email addresses, telephone numbers, school year, attendance, assessment and progress, relevant medical and special educational needs information, behaviour or incident notes where needed, payment details, and photographs only where you have given separate written consent.
Our lawful reasons
We only use personal information when the law allows it.
- Contract. To enrol your child, provide lessons and collect the fees you have agreed to pay.
- Legal obligation. Where the law requires us to keep or share information, including safeguarding and tax records.
- Legitimate interests. To run the centre, keep the website secure, and deal with enquiries, where those interests are not overridden by your rights.
- Consent. For a child's photograph, name or results in marketing, and for non-essential cookies. You can withdraw consent at any time.
- Vital interests. To protect someone's life, for example in a medical emergency.
We do not rely on a public-task basis. We are a private tuition centre, not a public authority, and we do not routinely send pupil records to the Department for Education or a local authority.
We do not make decisions about you or your child by automated means that have a legal or similarly significant effect.
Children
Parents and guardians are responsible for a child's use of the website. Information about a child belongs to that child. A parent or carer can act for a child who cannot understand a request. We will consider each request on the child's understanding, not on a fixed age alone.
Photographs and marketing
We will not use your child's photograph, name or results in marketing, on the website, or on social media without your separate written consent. You can withdraw that consent at any time. If you do, we will stop using the image and will not distribute it further.
Who we share information with
We share personal information only where we have a lawful reason:
- Payment providers, including Stripe and our direct debit provider, so we can collect fees.
- Email and communication tools we use to contact you about lessons.
- Google Analytics and Microsoft Clarity, only if you accept analytics cookies. See our Cookie Policy.
- Health, social care, the police or a local authority where safeguarding or another legal duty requires it.
- An examining body, if you ask us to support an entry to a public exam.
Suppliers who process information for us may do so only on our instructions and must protect it.
Transfers outside the UK
Some of those suppliers, including Google, Microsoft and Stripe, may process information outside the UK. Where they do, we rely on a lawful transfer safeguard, such as a UK adequacy decision or the UK International Data Transfer Agreement.
How long we keep it
We keep information only for as long as we need it for the purpose we collected it, then we delete it or anonymise it. If safeguarding information has been recorded about a child, we archive those records for the lifetime of that child. Fee and payment records are kept for as long as tax law requires.
Your rights
Under UK data protection law you can ask us for a copy of your personal information, or your child's where you are entitled to act for them. You can also ask us to correct it, erase it, restrict it, or transfer it in certain cases. You can object to processing based on legitimate interests, and you can object to direct marketing at any time. You can withdraw consent where we rely on consent.
