By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

In no case shall 11 Plus Grammar Preparation Success, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless GK Trading Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 10 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 11 – GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United Kingdom.

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 13 – PLACING AN ORDER

When placing an order with us, please ensure that you have checked the details of your requirement before submitting it. We will not be liable to you for errors or omissions you make. Each item needs to be correctly identified. If you have made a mistake, please contact us immediately so we may rectify this for you. A contract is only formed between us once we have sent you an Order acceptance. This email will include your billing information. Each order will be assigned an order number and order number needs to be quoted in all correspondence and contact with us. All Services which appear on the Application are subject to availability. If we are unable to fulfil your order, we will notify you in writing as soon as practicable

SECTION 14 – Cancellations & Refunds

Pass 11 Plus has the right to cancel subscriptions at any point.

  • If you no longer require our services you may cancel at any time by providing one month’s notice in writing or email only.
  • Monthly payments will be taken by direct debit. If payment is not made, Pass 11 Plus has the right to cancel its provision and recover any outstanding money owed. In all circumstances, 1 month’s notice is required for cancellations. If you are not cancelling at the start of your subscription payment cycle, you may have a final pro-rata payment to make, in order to complete the 1 month notice period required for cancellations.
  • The registration fee is non-refundedable.
  • We will aim to issue refunds within 30 days of confirming the user’s request.

11 Plus Grammar Preparation Success attending lessons as “Physical Lessons or online lessons” of which are subject to the following terms of use:

  • Attending your weekly lessons is a compulsory requirement that you agree to by adhering to these terms and conditions.
  • For any reason you are unable to attend your “physical lesson or online lessons”, it is a compulsory requirement to complete the uploaded work for the week.
  • For any reason you are unable to attend your “physical lesson or online lessons”, the lesson fee will be charged. Access to homework will be available until the fee received expires.
  • For any reason you are unable to attend your “physical lesson or online lessons”, will be classed as an absence; persistent unnotified absences may result in expulsion from future classes.
  • All fees are CHARGEABLE, regardless of notified or un-notified absences.
  • We retain the right to unenroll you from your selected tuition lesson with immediate effect and no prior notice.
  • If 3 consecutive “physical lessons or online lessons” are missed without reason or notification, you will be unenrolled as is stated above.
  • As completing the work online is essential to your child’s journey to the 11+ exam, if this is not completed during any time you are away, we also retain the right to unenroll you immediately without prior notice from your selected tuition lesson.
  • This is in your best interest as the 11 Plus Grammar Preparation Success Curriculum is regimented to follow a compounding weekly system. Our rigorous standards are set to ensure and maintain the child is on track to achieve and surpass targets set.

If the centre is closed due to adverse weather conditions or other situations that are beyond the control of 11 Plus Grammar Preparation, then alternative arrangements may be provided, but this is not guaranteed. No refund is provided in lieu. We will endeavour to provide an alternative venue, but if this is not possible, your child will receive online access to the weekly guided teaching session and corresponding worksheets.

11 Plus Grammar Preparation Courses, Mocks and Intensive Booster Courses

One off Payment.

Refunds will only be accepted in the first 14 days of starting the course.

11 Plus Grammar Preparation will aim to issue refunds within 30 days of confirming the user request.

SECTION 15 – Mock Exams

  • Completing a Pass 11 Plus Grammar Preparation Success Mock exam does not guarantee entry to a grammar or independent school.
  • All statistics provided after the exam are only given as guidelines and do not constitute a guarantee of any kind.
  • We will endeavour to send results out within 10 working days after completion of the exam. If results are not received after this period then it is an individual’s responsibility who booked the exam to make the necessary enquiries.
  • Please note that you will not receive a copy of the exam paper. We ensure that each exam paper tests and reflects the latest information that we have available regarding eleven plus exams.
  • Please note: We ensure all our 11+ tutors are CRB/DBS checked before we allow them to work with children, whether that be online or in our centres.

SECTION 16 – Other Key Information:

Individual exam booking:

Cancellations of individual mock exam bookings can be made 2 weeks prior to the exam date. We will aim to issue full refunds within 30 days of confirming the customer request. Please note, this does not include multiple exam package bookings. However, in extenuating circumstances, we may be able to offer a refund of up to 25% of the original booking price, but this facility CANNOT be guaranteed and will be provided at the discretion of Pass 11 Plus Grammar Preparation Success. Under circumstances where another mock exam event is available, we may offer to transfer your child’s booking, subject to an administration fee of £20. Any alterations would make the booking non-refundable and non-transferable to any other product or course offered by us and be subject to availability.

Cancellations made within 2 weeks of the exam date will NOT be issued a refund.

Multiple exam package booking:

Cancellations cannot be made on individual mock exam events when booked as a multiple exam package booking. If you wish to cancel the full multiple exam package, this is only possible up until the first Saturday in January.

SECTION 17 – Intensive Booster Revision Courses

Cancellation Notice: 1 calendar month before start date of assigned course.

Refund Policy: Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.

We will aim to issue refunds within 30 days of confirming the user request.

Late Pick Ups

Any late pick ups interrupt staff time, so a charge of £10 will be applied to parents arriving more than 15 minutes after the session finish time. This fee of £10 will be charged for every 15 minutes (after first 15 mins) that a child is under the care of 11 Plus Grammar Preparation staff over the agreed allocated time.

SECTION 18 – Booster Courses

Cancellation Notice: 1 calendar month before start date of assigned course.

Refund Policy: Cancellations made prior to 1 calendar month before the assigned course start date will be issued a full refund; Cancellations made within 1 calendar month of the assigned course start date will NOT be issued a refund.

We will aim to issue refunds within 30 days of confirming the user request.

SECTION 19 – Workshops

Cancellation Notice Period: 2 Weeks before the day of assigned workshop date. Any changes to session times and dates MUST be requested prior to 2 weeks of the assigned workshop date.

Refund Policy: Cancellations made prior to 2 weeks before the assigned workshop start date will be issued a full refund; Cancellations made within 2 weeks of the assigned workshop start date will NOT be issued a refund.

SECTION 20 – One to One sessions

Cancellation Notice Period: 2 weeks before the day of assigned One to One session.

Any changes to session times and dates MUST be requested prior to 2 weeks before the assigned One to One session.

Refund Policy: Cancellations made prior to 2 weeks before the assigned one to one session date will be issued a full refund; Cancellations made within 2 weeks of the assigned One to One session start date will NOT be issued a refund.

21. Payment terms

  • 21.1. Parents/pupils will have an invoice drawn up on the 24th of each month for all lessons scheduled in the next month. Invoices will be made available on the client portal and also emailed to the main email address provided upon registration. Invoices will then subsequently be collected automatically through the parent portal from the assigned debit/credit card 3 days from being made available, unless an approved third-party payment service is being used, in which case payment will be made via the approved third-party payment platform.
  • 21.2 . Invoices can be accessed by logging into a parent portal and will also be sent via email. It is the responsibility of parents/pupils to check their emails for invoices or log in to their portal to view their invoices.
  • 21.3 . Payment can only be made by debit/credit card through our parent portal or via one of our approved payment schemes that use a third-party payment system. Payment for lessons made via any other payment method may incur a £10 payment administration charge. Upon receiving invoice payment must be made in full within 3 days of receiving the invoice.
  • 21.4. Please note invoices MUST be paid by the due date. Failure to do so may incur an administrative of up to £60 and your child will be withdrawn from any further lessons until the outstanding balance is settled.
  • 21.5. Online sessions are only available for the registered child. No one else is allowed to attend the session. This will result in a breach and the child may be expelled without any reimbursement.
  • 21.6. All late payments will result in a 10% late fee – also payable prior to attendance

22. Sibling / additional lesson discounts

  • 22.1 Parents sending more than one child or booking more than one session in any given week will receive a discount of £1 per hour for each additional child/session booked.
  • 22.2 Siblings eligible for the discount must be from the same immediate family.

23. Referral Scheme Terms

  • The referral must be notified to us within four weeks of the referred member starting.

24. Free trial lessons centre and online based

  • 24.1 Free trial lessons at any of our face to face tuition centres are only applicable for group booster sessions.
  • 24.2 Only one free trial lesson is allowed per child regardless of the number of different subjects a child is studying.
  • 24.3 Free trial lessons can only be booked by completing the free trial lesson form, failure to complete this form before registration will forfeit the right to a free trial lesson.
  • 24.4 Free trial lessons at the centre are at the discretion of the centre manager and based on availability. We reserve the right to refuse a free trial lesson based on business needs.

25. Variation of fees and services

  • 25.1 Fees may be changed, and the services offered added to or withdrawn at any time. However, fees will not be varied during a course or other service in progress.
  • 25.2 Failure to adhere to the above requirements may result in the pupil(s) being withdrawn from future sessions.
